@SillyRoundKatie

Below this divider is the Terms of Service of my commissions! Apologies because this is quite a long wall of text, but it is important you read this fully before agreeing to take a commission spot from me, so that both I, the artist, and you, the commission purchaser, are fully protected!

Commission Terms of Service:

  • Process

  • I will start drawing when either the full amount (rough sketch comms) or the first half amount (lineart and rendered/shaded comms) has cleared into my Paypal account. "Cleared into my Paypal" means the balance is in my available funds, and thus if your payment comes through as an eCheque payment there may be a slight delay whilst this clears.

  • Every commission comes with free revisions (within reason). Sketch comms get three free revisions. Lineart and rendered / shaded comms get three free revisions at the sketch stage, and then three more after lineart / rendering / shading.

  • Revisions are classed as minor anatomical changes, minor additions, minor pose alterations, or anything else that could reasonably fall under this category. Free revisions do not include sudden character additions, extra panels on a comic commission, large stylistic overhauls, complete pose changes, or anything else that would reasonably fall under this category.

  • Extra changes will be charged extra depending on their complexity (minor/major) based on how long it will take me to enact them. I have the right to refuse extra changes if it changes the course / direction / concept of the comm drastically.

  • Let me know in advance if you need the comm to be a specific dimensions / size, as altering this afterwards may affect the quality of the commission received.

  • As I currently work full-time as a PhD student, my current turn-around times are highly variable, and depend on the complexity of the commission. Currently, I expect to get the artwork commission to you within 2 weeks (simple commissions/low PhD workload) - 6 months (complex commissions/high PhD workload). If you take a commission spot from me, you are agreeing to this timeline. However, I will always try and finish it for you as soon as I am able! I will always notify you asap if I believe there may be a delay.

  • I can finish work for a specific date if you tell me in advance (i.e if the comm is a gift for someone's birthday or you have any other sort of deadline) but I will charge an additional rush fee that will vary depending on how soon the piece needs to be finished. Any piece that needs a certain finish date must be mentioned beforehand in the initial commission discussion, otherwise I am not required to meet it.

  • Payment

  • All my commissions are priced in GBP (British Pound Sterling), you can pay me in any currency to my PayPal and PayPal will automatically convert to the correct GBP price. Please use a currency converter to check what the converted price will approximately be to avoid any surprises! I do not take payment via cryptocurrency.

  • References

  • Visual references for characters are preferred, I will work from both pre-existing art of a character, and using "faceclaim" style references.

  • Text description references of characters are allowed, however please keep the text description focused on aspects that will be most important to me as an artist - what they look like, how they hold themselves due to their personality, any important props they have. I do not need a character's full biography unless a plot point is important / relevant to the commission at hand (and then please simplify it if possible).

  • I work in a few different styles (from extremely cute and cartoony to extreme horror style) so it's important you let me know which style you would like me to work in. Feel free to point at previous work I’ve done and go “like that please”.

  • Pose / composition references are always helpful, and this includes images you found on the internet, or even a quick stick person drawing!!

  • Ownership Rights

  • Do not resell my artwork in any form unless we have a particular arrangement explicitly agreeing to this beforehand. However you can reprint / use online etc my work for your own personal use only freely.

  • Commercial work is separate to personal art commissions in this regard, and if you aren't sure which type your commission is, unless we explicitly discussed you buying ownership rights for commercial use, it isn't, and you have the rights for personal use only. Please ask for commercial rights if you intend to sell merchandise with my artwork on it, use it as the cover of a book you are selling, or anything of this nature (i.e you are making further money from selling something with my work on it).

  • Regardless of whether the art falls under personal use or commercial rights, you still need to credit me as the artist, even if the image is further altered / edited.

  • You do not have the right to create a NFT / other crypto art token or any other term for something of this nature, with any art created by myself.

  • I, as the artist, unless we agree to a "private commission", have the right to post the artwork to my art sites in order to promote myself and my commissions. You most notify me beforehand during the initial commission conversation if you do not wish for me to post your finished commission anywhere.

  • File delivery

  • Once a commission is completed, I will upload the final high quality files to a Google Drive folder that will be shared either via sharing link or to your email, and you can download and view the final high quality files there. It is your job to download these files to your own computer / own file hosting service promptly to ensure they are not lost. I cannot host the files forever, and I retain the right to delete the files in 6 months time.

  • Commission completion concludes with me uploading the digital files containing your artwork to the Google Drive folder, unless we explicitly make an agreement for traditional artwork that I will mail to you, you will not receive any physical item from me, and you will need to mark the Paypal invoice as "no shipping needed" as a result.

  • Refund Policy

  • I have the right to cancel a commission at any time. I will refund you fully if I haven't worked on the commission but you have paid me for it. Example: if you buy a lineart comm from me and I finish the sketch that you approve, but I have to cancel before I begin lining it, you will receive a refund for the lineart payment portion, but not the sketch payment portion.

  • You can cancel a commission from me at any time. If I haven't started working on your piece, but you have paid me money, you will get a full refund. However, if I have started working on your piece, refunds will be affected. If I have worked up to the amount you have paid for: e.g you pay for a sketch comm, I provide a sketch, but then you cancel, I will not refund you. Examples: If you pay for a lineart comm, pay the first half and receive a sketch that you confirm, pay the second half, I haven't begun lining the piece, you cancel, you will receive a full refund for the lineart portion of the work (that I didn't begin). If you pay for a lineart comm, pay the first half and receive a sketch that you confirm, pay the second half, I begin lining the piece, you cancel before I finish, you will not receive a full refund for the lineart portion of the work (because I had begun working on it). Depending on how close I was to finishing the lineart, you may not receive any refund at all.
